The rights of the employer

1- Experience of the domestic worker.

The parties may agree to put the domestic service worker under probation for a period of not more than ninety days, during which the employer shall verify the professional competence of the domestic worker and the safety of his personal conduct. Of the employer himself, unless the parties agree that domestic workers shall be employed in a different work than his first.

2. Contracting.

The work relationship between the domestic worker and the employer shall be regulated by a written contract and shall be based on proof of the Arabic text of the contract. The contract shall be edited and translated, if any, of three copies, each of which shall keep a copy and the third shall be deposited with the recruitment office. The employer signs the contract with the domestic service agent with the following clearly defined elements:

• The type of work the domestic service worker is committed to performing.

• The wage that the employer is obliged to pay to the domestic worker

• Rights and duties of the parties

• Duration of the experiment

• Contract duration and how to extend it

3. Termination of the contract during the trial period without any liability.

The employer may terminate the contract at his own will during the trial period without any liability, if it is proved that the domestic worker is inefficient.

4. Upon expiry or termination of the contract for an illegal reason.

If the contract is terminated, the employer has terminated it for an illegal reason, or by the domestic worker for a legitimate reason, the employer must bear the payment of the ticket to return the domestic worker to his country.

5. When the contract ends with the death of one of the parties.

The contract ends with the death of the employer or the domestic worker. If the employer's family wishes to continue the domestic worker, the employer must check with the employment office to correct the employer's name.

6. When the domestic worker is absent.

When the domestic worker leaves the employer to inform the nearest police station of his or her home, the police station shall do the following:

• Inform the Passport Department of leaving the worker to take action.

• The employer's office must do so to ensure that the domestic worker does not have a claim against the employer, or the employer has a claim against the worker, and when there is an action, the labor office must inform the Passport Administration.

• Provide the copy with a copy of the work permit.

The duties of the employer towards the domestic worker

1. Agreed work.

The employer shall:

• The domestic service worker shall not be charged without the work agreed upon in the contract or by working with others.

• It does not cost the domestic service worker to carry out any hazardous work that threatens his or her health, integrity or human dignity.

• Not hire a domestic worker or allow him to work for his own account.

2. The agreed wage.

The employer shall:

• The agreed wage shall be paid at the end of every Hijri month for the domestic worker, unless the parties agree - writing - otherwise.

• The wage and its dues shall be paid in cash or by check, and this shall be documented in writing, unless the worker wishes to transfer it to a specific bank account.

3. Deduction from remuneration.

It is not permissible to deduct from the wages of a domestic worker except in the following cases and not exceeding half of the wage:

• Costs of intentionally or negligently causing damage

• An advance received from the employer

• The execution of a judgment or administrative decision against him, unless the judgment or the administrative decision stated that the deduction is more than half the wage.

4. Domestic Service Agent.

The employer is obliged to provide adequate housing for the domestic worker.

Punishment of the violation by the employer

Without prejudice to the penalties provided in the other regulations, the employer who contravenes the provisions of these regulations shall be punished as follows:

• A fine of not more than two thousand Riyals, or to prevent him from recruiting for one year or both.

• If the offense is repeated, he shall be punished with a fine of not less than two thousand riyals, and not more than five thousand riyals, or to prevent him from recruiting for three years, or both.

• If the violation is repeated for the third time, the Committee can prevent the violator from bringing in permanently

• The penalty is multiplied by the number of irregularities fixed on the employer.
